Off-plan buying process 01

Six checks before you pay a booking amount

  1. The project has an escrow account

    Dubai requires a separate escrow account for each off-plan project, used only to build it. Abu Dhabi requires one per project and phase. RAK's 2023 decree, as reported, requires one held with a RERA-registered trustee.

  2. You pay only into that escrow account

    Check the account details against the developer's own documents and never pay a deposit to an intermediary. Escrow rules protect money paid into the project escrow account.

  3. The home is in a freehold area

    In Dubai, Law No. (7) of 2006 lets non-UAE nationals own freehold in areas designated by the Ruler. Abu Dhabi uses investment areas fixed by Executive Council decision. RAK Municipality names freehold areas including Al Hamra Village, Mina Al Arab and Al Marjan Island. Check the plot, not just the community name.

  4. The SPA and project documents have been read

    Have a UAE-qualified lawyer read the payment schedule, completion, delay, default and termination clauses and the fee clause. In Abu Dhabi, off-plan sales also require an approved disclosure statement.

  5. The advert has a permit

    Dubai property adverts need a DLD permit issued through Trakheesi. Abu Dhabi developers obtain an off-plan advertisement permit with a QR code on DARI. RAK developers need written permission from RAK RERA.

  6. The sale will be registered

    Ask how and when the sale will be entered on the off-plan register. In Dubai, DLD says contracts must be registered within 90 days of signing. Keep the proof with your SPA.

What you own during construction: a registered contract

An off-plan purchase is a contract for a home that is not yet finished. You sign a sale and purchase agreement (SPA) with the developer, pay a booking amount, then pay the balance in instalments tied to dates or construction progress, with a further amount usually due around handover. You hold a registered contract during construction and a completed home only at the end.

Registration is what makes that contract count. Dubai's Law No. (13) of 2008 says an off-plan sale is void unless it is entered in the Interim Property Register. Abu Dhabi's Law No. (3) of 2015 says off-plan dispositions bind no one unless recorded in the Initial Real Estate Register.

From shortlist to title deed, step by step

The general sequence in Dubai, Abu Dhabi and Ras Al Khaimah. Your SPA sets the exact order, amounts and deadlines.

    Shortlist and check the location

    Confirm the home sits in an area where foreign nationals may own freehold. Check the specific plot, not just the community name.

    Check the developer and project

    Confirm the developer and project are registered with the regulator, that a project escrow account exists and that the marketing carries an advertising permit.

    Read the SPA before reserving

    Read the payment schedule, completion and delay clauses, default and termination terms, and who pays each registration fee.

    Pay into escrow and register

    Pay the booking amount into the project escrow account and make sure the sale is entered on the emirate's off-plan register.

    Staged payments during construction

    Pay instalments as the schedule requires, keep every receipt and follow the project's progress through the developer and official records.

    Completion and handover

    Inspect the home, settle the handover payment, receive the keys and complete the move from interim registration to a title deed.

    After handover

    Occupy or let the home and budget for service charges. Rental income can start only from this point and is not guaranteed.

Plan for no income until handover, then service charges

Completion dates in brochures and releases are developer-stated targets, and your SPA, not the marketing, sets what happens if handover is late. Until the home is handed over it produces no rental income, so plan to fund every instalment from your own resources.

After handover you take on running costs, including service charges for shared buildings and communities. In Dubai, the Service Charge Index is a free public lookup of RERA-approved service fees for jointly owned properties, searchable by project, use and year, so you can see the level of charges on comparable completed buildings before you commit.

Escrow means payments into the project account can be used only for building that project, and in Dubai the developer's creditors cannot attach them. It does not guarantee completion on the developer-stated date. Payments made outside the escrow account may not have the same protection.

Only after the home is completed and handed over to you. Before then there is nothing to let. Rental income after handover depends on the market and your costs, and it is not guaranteed.
